The three-day conference has resulted in very interesting and passionate debates. The participants were not invited to deliver a formal communication but to take the floor on a spontaneous basis. Each contrbiution thus is quite short and reflects an oral-style.

Je pense qu’il faut ramener dans nos débats un acteur que j’estime et qui n’est pas très représenté ici, à savoir les témoins. Demain, nous allons peut-être parler de l’héritage du Tribunal, nous parlerons de la jurisprudence, mais je pense que le travail, l’œuvre du Tribunal a été écrit par un acteur important : les témoins. Les témoins qui ont témoigné pour le Procureur ou pour la Défense. Je pense que ces témoins, surtout les témoins rwandais, ont eu un rôle important (...)

    Je voudrais revenir en élargissant un peu la question sur la politique de la poursuite. Il a quand même existé à partir de 2001, 2002, 2003, des listes qui ont eu divers noms dans lesquelles figuraient 200 à 300, même une fois 340 et quelques noms de personnes susceptibles d’être poursuivies. La question que je me pose aujourd’hui est la suivante : un certain nombre de personnes, au moment de cette effervescence, avaient décidé non pas de se livrer, mais en tout cas de se laisser arrêter en se disant que la frénésie étant telle qu’elles n’y échapperaient pas.     The witness and the evidence - witnesses
    Thank you. I have a question. Evidence at the ICTR is mostly on the basis of testimony. Now, there is a concept that is widespread: the issue of false testimony or perjury. I have a question for all the stakeholders that face this problem. Prosecution and Defence are on their own, witnesses and the witnesses of the other side. How is this issue managed? How should it be managed, the issue of false testimony, which to me is quite important?

    I think in some respects the witness protection regimes in the ICTR have not caught up to the changes in the global situation of witnesses introduced by Gacaca in Rwanda. In a context where Gacaca forces everyone to testify without any sort of protection, it makes the way we’ve approached witness protection in the ICTR out of pace with global developments in managing witnesses of genocide.     I shall be very short. I just wanted to say that the problem raised by the witness is not solved by the recognition that this system is like this or this system is like this. I think that one of the good things that come out of here is to recognise that we must build a system that will bring a proper enquiry to bring out the truth and at the same time respect the dignity.
