The three-day conference has resulted in very interesting and passionate debates. The participants were not invited to deliver a formal communication but to take the floor on a spontaneous basis. Each contrbiution thus is quite short and reflects an oral-style.

Mais j’aimerais d’abord, avant de poser des questions précises aux Procureurs — au pluriel, au féminin et au masculin — préciser que la création du Tribunal à Arusha n’était pas due à l’état de délabrement des institutions à Kigali.     Je veux bien prendre la parole, si vous le permettez. Je vais commencer par la question de la définition de la politique pénale. On a entendu différentes réflexions. Elles sont toutes bonnes parce que la première chose à faire en tant que procureur, est d’établir les faits avant de commencer à travailler. C’est-à-dire qu’il faut que vous sachiez comment se sont déroulés les faits, comment les actes illicites et les crimes ont été commis, quels sont les faits.     Just two very small remarks. One is about the investigation of the presidential plane. In my view, I don’t think that the Rwanda Tribunal is a tribunal that will be judged negatively because of the non investigation of the presidential plane. Leave alone the jurisdictional issue. J’aimerais intervenir sur la question de cet acte de piraterie aérienne pour lequel, paraît-il, tous les procureurs ont dit qu’il ne relevait pas du mandat du TPIR. J’aimerais l’aborder sous deux angles. Le premier angle est celui des Conventions de Genève. Si vous vous rappelez bien, le 4 août 1993, un accord de paix a été signé sous la houlette des Nations unies, de l’Union africaine et avec la facilitation de la Tanzanie.
